IN ALL CASES, STARBIRD CHICKEN'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO STARBIRD CHICKEN IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law. In such jurisdictions, our liability will be limited to the greatest extent permitted by applicable law.

8. Indemnification

You agree to defend, indemnify, and hold harmless Starbird Chicken, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, suppliers, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

9. Food Safety and Allergen Notice

Starbird Chicken takes food safety and customer health seriously. However, we cannot guarantee that our food products are free from allergens, as our kitchen facilities may handle common allergens including peanuts, tree nuts, wheat, gluten, soy, milk, eggs, fish, and shellfish. Cross-contamination is possible during preparation.

10. Governing Law and Jurisdiction

We will attempt to resolve the dispute within thirty (30) days of receiving your notice. 11.2 Binding Arbitration

EXCEPT FOR CLAIMS THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS UNDER THE FEDERAL ARBITRATION ACT (9 U.S.C. § 1 et seq.) AND ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (AAA) IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES, WHICH ARE AVAILABLE AT www.adr.org.

The arbitration shall be conducted in English and shall take place in the United States. The arbitrator shall have the authority to award any relief that would be available in court. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU AND STARBIRD CHICKEN AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate or join the claims of more than one person or party and may not otherwise preside over any form of a consolidated, representative, or class proceeding.

11.4 Jury Trial Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO A JURY TRIAL FOR ANY CLAIM OR CAUSE OF ACTION ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES.

11.5 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction, provided that the action remains in small claims court and is not removed or appealed to a court of general jurisdiction.
